1. About Nuqta
Nuqta Creative House is a branding and creative design studio registered in the Sultanate of Oman, specializing in brand identity design, brand collateral design, campaign design, and home branding. These terms govern your use of our website and any services we provide.
2. Services
Nuqta offers branding and design services including, but not limited to, brand identity design, brand collateral design, campaign design, and home branding. The scope, deliverables, timeline, and cost of each project are defined through a tailored quotation and creative brief agreed upon before work begins.
3. Quotations and Payments
- All quotations are prepared based on the specific requirements of your project and are valid for 30 days unless stated otherwise.
- A deposit may be required before work begins. The deposit amount and payment schedule will be outlined in your quotation.
- Final payment is due upon delivery of the completed project files, unless alternative arrangements have been agreed in writing.
- Prices are quoted in Omani Rials (OMR) unless otherwise stated.
4. Project Process and Timelines
Our standard branding process includes a concept development phase (15-20 working days) and an application design phase (15-20 working days). Up to two rounds of refinements are included in the concept phase. Additional revision rounds or significant scope changes may incur extra charges and extend the timeline. Timelines assume timely feedback from the client. Delays in providing feedback, approvals, or required materials may result in adjusted delivery dates.
5. Intellectual Property
- All creative work produced by Nuqta remains our intellectual property until full payment has been received.
- Upon full payment, ownership of the final approved deliverables transfers to the client for the agreed-upon use.
- Nuqta retains the right to showcase completed projects in our portfolio, website, social media, and promotional materials unless otherwise agreed in writing.
- Preliminary concepts, unused designs, and rejected directions remain the property of Nuqta and may not be used by the client.
6. Client Responsibilities
- Provide accurate and complete information during the briefing stage.
- Provide timely feedback and approvals to keep the project on schedule.
- Ensure that any materials, references, or content provided to Nuqta do not infringe on any third-party rights.
- Review and approve all final deliverables before production or public use.
7. Cancellations and Refunds
If a project is cancelled after work has commenced, the client is responsible for payment of all work completed up to the point of cancellation. Deposits are non-refundable. Nuqta reserves the right to retain all work produced up to the cancellation date.
8. Confidentiality
We treat all client information and project details as confidential. We will not share your business information with third parties except as required to deliver the project (e.g., print production partners) or as required by law.
9. Limitation of Liability
Nuqta provides creative and design services in good faith. We are not liable for any indirect, incidental, or consequential damages resulting from the use of our designs, including but not limited to lost profits, business interruption, or reputational impact. Our total liability for any claim related to our services shall not exceed the total fees paid by the client for the specific project in question.
10. Website Use
- All content on nuqta.cc, including text, images, logos, case studies, and design work, is the property of Nuqta Creative House and is protected by intellectual property laws.
- You may not reproduce, distribute, or use any content from this website without our prior written consent.
- We reserve the right to update or modify the website and its content at any time without prior notice.
11. Third-Party Services
Our website may link to third-party platforms (Instagram, LinkedIn, Behance, WhatsApp, etc.) and references our sister brand HAMA. We are not responsible for the content, services, or practices of any third-party platforms or businesses.
12. Governing Law
These terms are governed by and construed in accordance with the laws of the Sultanate of Oman. Any disputes arising from these terms or the use of our services shall be subject to the exclusive jurisdiction of the courts of Muscat, Oman.
13. Changes to These Terms
We reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page with a revised effective date. Continued use of our website or services after changes are posted constitutes your acceptance of the revised terms.
